1. Introduction and Agreement

Welcome to Apex Builders Mart. These Terms & Conditions govern your relationship with us and your use of our physical store located in New Delhi, as well as any associated supply chain services or consultations. By purchasing building materials, construction supplies, or engaging our services, you agree to be bound by the terms detailed herein. If you do not agree to these terms, please refrain from conducting business with us.

2. Product Availability and Specifications

We pride ourselves on offering premium, industry-grade building and construction materials. However, due to the bulk nature of our industry and global supply chains, product availability and specifications may change:

• All construction materials, including cement, TMT steel bars, timber, and aggregates, are subject to stock availability at our Lajpat Nagar depot.
• Natural variations in color, texture, and size may occur in raw materials such as natural stone, brick, and unseasoned timber. These variations are inherent characteristics, not defects.
• Apex Builders Mart reserves the right to discontinue or alter product lines, brands, or suppliers without prior notice.

3. Pricing, Taxes, and Payments

All prices provided in official quotations or displayed in-store are denominated in Indian Rupees (INR). Unless explicitly stated on your invoice, prices are exclusive of applicable taxes, including the Goods and Services Tax (GST), handling fees, and delivery charges. Payment must be completed in full prior to the dispatch of materials from our premises unless a separate commercial credit agreement has been formally established in writing. We accept standard payment methods approved by Indian banking authorities.

4. Delivery, Inspection, and Returns

Delivery timelines are good-faith estimates and are contingent upon commercial transport availability, vehicle restrictions, and local traffic conditions throughout Delhi NCR. It is the buyer's strict responsibility to inspect all materials upon delivery at the construction site. Any claims regarding shortages, damages in transit, or defective materials must be reported to our sales team in writing within 24 hours of receipt. Returns of bulk construction materials (e.g., loose sand, opened cement bags, custom-cut steel) are strictly not accepted unless proven inherently defective prior to actual use or mixing.

5. Liability and Manufacturer Warranties

Apex Builders Mart acts primarily as a distributor and retail agent for various national and international manufacturing brands. Warranties on specific manufactured products (such as bagged cement, waterproofing compounds, or architectural hardware) are provided solely by their respective manufacturers. We do not assume liability for structural failures, project delays, or construction defects arising from the improper application, inadequate engineering, or misuse of the materials purchased from us.

6. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed entirely in accordance with the laws of India. Any disputes, claims, or legal proceedings arising out of or related to these terms, our products, or our delivery services shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, Delhi.
